There is a decision regarding the regional station of Polish Radio. For the third time, Sienkiewicz was proven right
By decision of the Warsaw court, the opening of the liquidation of the RDC company was entered into the National Court Register. The same will probably apply to applications regarding other radio companies, says lawyer Paweł Prus.
Presidential veto, which, among other things, suspended the financing of public media (let us remember – it was PLN 3 billion), caused the Minister of Culture, Bartłomiej Sienkiewicz, to put the public media into liquidation. He later appointed liquidators.
Radio for you RDC is subordinated to Radio dla Młodych SA and managed by the capital city of Warsaw. Warsaw – remind Virtual Media. The liquidator of regional public radio stations, including RDC, is attorney Paweł Kusak.
RDC entered into the National Court Register
On January 12, the Ministry of Culture and National Heritage announced that the Warsaw District Court had entered the opening of the liquidation of Radio dla Młodych SA in the National Court Register.
Lawyer and media market expert Paweł Prus reminds on X/Twitter that this is the third company that has been entered into the National Court Register. “What is important: the entries were made by three different courts, in different cities,” he adds. The same decision was made by the Gdańsk court in the case of Radio Gdańsk, and earlier – by the Katowice court regarding the company: Polskie Radio – Regionalna Rozglonia w Katowice SA. In the last decision, lawyer and MP Roman Giertych commented on the case briefly and eloquently: “Sienkiewicz won.”
Will other companies also be entered in the National Court Register?
The president of the regional radio station, Tadeusz Deszkiewicz, issued a statement after Sienkiewicz’s decision. He took the position that the Minister of Culture’s decision to put it into liquidation was “unlawful.” “The only institution that can make personnel decisions, appoint and dismiss management boards and supervisory boards of public broadcasting companies is the National Media Council,” he claimed.
Both he and the presidents of the majority (14 out of 17 in total) of the Polish Radio Regional Broadcasting companies declared that “the decision (to liquidate – editor), regardless of the style in which it is communicated, is inconsistent with the applicable regulations and the Constitution of the Republic of Poland.” – we read.
However, the courts seem to agree with the Minister of Culture, Bartłomiej Sienkiewicz. “It can be assumed that applications regarding the remaining 14 radio companies, TVP and PAP will also be entered into the National Court Register,” says expert Paweł Prus.
