Glapiński files a complaint against the prosecutor's decision regarding Tusk's words from July 2022
Adam Gapiński did not agree with the decision of the prosecutor from Radom, who two weeks ago discontinued the proceedings regarding the alleged threats made by Donald Tusk. The complaint will be considered by the District Court in Radom.
At the PO election convention in Radom on July 2, 2022, Donald Tusk said that if PO wins the elections, he will “take Glapiński out of the NBP”. – Adam Glapiński is not only incompetent, not only indecent in what he does. Adam Glapiński is also illegal. He will not be the president of the National Bank of Poland a day longer. There will be no need for a law, said Donald Tusk. He recalled that there were doubts as to whether Glapiński could be appointed for a second term as the president of the NBP, and they were also raised by lawyers of the Chancellery of the President. – Much less doubt would be enough to remove the guy from the NBP. And I will do it, I guarantee it to you, said the PO leader then.
Glapiński appealed against the prosecutor's decision regarding Tusk's words
Glapiński perceived these words as a threat and submitted a report to the District Prosecutor's Office in Radom. On February 16, the court decided to discontinue the proceedings due to no violation of the law.
“The questioned fragments of Donald Tusk's speech, even if subjectively unpleasant or harmful from the perspective of Adam Glapiński, were not intended to humiliate him, and the entire statement is political criticism,” it was written in the justification for the decision to discontinue the proceedings.
The decision was not final and Glapiński had the right to file a complaint, which he did on Tuesday, February 27. The complaint will be considered by the District Court in Radom.
After an investigation lasting over a year and a half, the prosecutor found that Tusk's statement regarding “taking out” Glapiński from the NBP did not meet the criteria of a crime specified in Art. 128 of the Penal Code, which talks about the forcible removal of a constitutional body of the Republic of Poland. – Apart from a single statement, no actions were taken that would directly aim at the violent removal – which is important – of a constitutional organ of the state, nor were any actions taken in this direction – explained Agnieszka Borkowska, spokeswoman for the District Prosecutor's Office in Radom, in an interview with PAP.
