Fest Festival canceled, customers fight for refunds. The agency promotes another event
Although the Fest Festival company declared bankruptcy, and the festival in Chorzów was canceled a few days before the start, the concert agency promoting the event invites you to the next one. He informs that “The Wisłoujście Festival is a completely independent entity” and will take place in August. Customers who have bought a ticket to the Fest fight in various ways to get their money back.
At the end of last week it became clear that the next edition of the Fest Festival in Park Śląski in Chorzów will not take place. On August 4, the organizer confirmed disturbing media leaks and announced that “it was forced to launch bankruptcy proceedings”. Tickets, as with other multi-day festivals featuring international stars, were not cheap. For example, a four-day “last chance” pass with a place on a campsite cost PLN 1,079, a weekend pass with a campsite – PLN 839, and a weekend pass without a campsite – PLN 639. The organizer (via the festival’s fanpage, not the concert agency) announced that the situation “prevents the payment of any amounts due by the company at the moment”.
Is it really too late for customers? We asked attorney Michał Gajda, who runs a law firm in Szczecin, about it.
“The road to bankruptcy is not as simple and quick as it may appear from a rather laconic statement of the organizer or comments in discussion groups in social media. In order to initiate insolvency proceedings, the company must submit an application to the competent court. According to Art. 27 sec. 3 of the Bankruptcy Law, the court issues a decision on declaring bankruptcy within two months of submitting the application.
The lawyer added that “until bankruptcy has been declared, customers can apply for a refund for purchased tickets – depending on the form of sale – either directly to the organizer or to the sales platform“. He noted that “in the case of tickets purchased directly from the organizer, we can make claims until bankruptcy is declared.”
