Will there be penalties? The implementation of the e-Delivery address is progressing well in December

E-Delivery is the electronic equivalent of letters with acknowledgment of receipt, which is intended to facilitate correspondence between public institutions, entrepreneurs and citizens. In short, it is to eliminate the hated advice notice.
From January 1, 2025, e-Delivery has become mandatory for most public institutions throughout Poland, for people performing public trust professions and for companies registering in the National Court Register. From July 1, 2025, e-Delivery became mandatory for entrepreneurs registered in CEIDG before January 1, 2025, making any change to their entry, and from October 1, 2026, they will become mandatory for all companies registered in CEIDG until December 31, 2024.
E-Delivery is mandatory, period
As Izabella Tarnowska, head of the e-Delivery team at the Central IT Center (COI), said at a meeting with the media, ADE was implemented by all “key entities”, i.e. municipalities, poviat offices and voivodeship offices, in accordance with the plan.
However, smaller entities, such as small nurseries and kindergartens attended by few students, failed to fulfill their obligations. such facilities have not previously used the e-PUAP system, which e-Delivery is intended to replace. According to Izabella Tarnowska, they are not used to the new method of communication, but this does not mean that they can give up the obligation to implement e-Delivery. The Ministry of Digitization constantly offers webinars, training and individual invitations.
To set up e-Delivery, you must submit an application for an address (ADE) and activate the mailbox via the website edoreczenia.gov.pl or biznes.gov.pl (for companies) using a Trusted Profile, e-ID or qualified signature.
Penalty for failure to implement e-Delivery
The good news is that the Ministry of Digital Affairs does not plans penalties against entities that have not fulfilled the obligation to establish an ADE. – Digitization is never a compulsion, it is always new opportunities. Let us remember that schools have different ways of communicating with parents or their communes. However, we have offices who have not set up ePUAP for 18 years, and now they have set up e-Delivery and this is important – he absolved the stragglers Deputy Minister of Digitization Dariusz Standerski.
His experience shows that e-Delivery is possible more willingly used where more units have implemented an electronic document circulation system, i.e. EZD RP. – Without full implementation of electronic document circulation, it is difficult to require absolutely all entities to implement e-Delivery under the threat of sanctions – explained the deputy minister.
The Electronic Document Management System (EZD RP) can be used free of charge by all public entities, including offices. EZD RP is developed by the Ministry of Digitization and NASK, as part of funds from the National Reconstruction Plan.
