A terrace or driveway may increase the area covered by the retention reduction fee. However, the tax appears only after three conditions are met.

The owner of a large and heavily concreted property may be required to pay a fee for reducing natural land retention, called a rain tax or concrete tax. Although the solution was introduced primarily for entrepreneurs, in certain cases it may also cover private property.

Just building a terrace or a driveway for a car does not mean that you have to pay. The fee is charged only when the property simultaneously meets three criteria specified in the regulations.

Three conditions for calculating concrete tax

The first condition is that the property must have an area of at least 3.5 thousand square meters. sq m The second is the location of the plot in an area not covered by a storm sewage system. The third criterion concerns the degree of development or concreting of the property.

A fee may be charged if, as a result of development or other works, more than 70 percent plot area has lost its biologically active character. This means that rainwater cannot freely soak into the ground.

Terrace and driveway may reduce retention

The premise for subjecting real estate to a fee is not only the construction of a building. Any project permanently connected to the land that limits the natural retention and absorption of water may be important.

Such elements may include a concrete terrace or a car driveway. Their area may be taken into account when determining what part of the plot is no longer biologically active. However, this does not mean that every owner of a house with a driveway has to pay tax.

Private homes rarely meet all the criteria

The fee was introduced mainly to limit the concreting of large properties, including those belonging to entrepreneurs and covering large squares. Typical private properties usually do not reach 3.5 thousand square meters. sq m or they do not have more than 70% concrete. terrain.

Therefore, a homeowner may be subject to the fee only if his or her property exceeds the required area threshold, is located outside the stormwater drainage system and is largely devoid of biologically active land. In practice, such cases are rare.

The owner must submit a declaration to the commune

Persons obliged to pay the fee should provide the commune with a declaration regarding the area of the property and the degree of its concrete coverage. On this basis, the amount of fees for reducing natural field retention is determined.

After carrying out the calculations, the commune head, mayor or city president informs the owner about the amount of the fee. The mere fact of having a terrace or driveway does not constitute an obligation. The cumulative fulfillment of all three statutory conditions is decisive.
