The Sejm hits the pathodeweloper. There will be new responsibilities
The Sejm adopted new provisions for developers. The warranty rules and obligations to publish the prices of apartments will change.
The Sejm adopted amendment to the real estate market regulations. The new regulations introduce changes to the rules of developers’ responsibility for disadvantages of residential premises and impose an obligation to openly the prices of apartments.
Construction defects
The adopted amendment to the Act provides that developers will be liable under the warranty for building defects also in the case of apartments and houses purchased on the basis of development agreements. Until now, such contracts, concluded in the form of a notarial deed before transferring ownership, have not always guaranteed the buyer the possibility of reporting defects after the investment.
The new regulations fill this gap, expanding legal protection to cases when the premises are purchased on the basis of a contract obliging to transfer ownership, and not directly through the sales contract. Projectors-Polish MPs 2050-td-argued that the current provisions put buyers using the development agreement in a less favorable situation than those who buy the property directly.
434 deputies voted in favor of adopting the law, no one was against, nobody abstained. The act will now go to the Senate.
More changes
However, this is not the end of the changes. In June, the president signed an act regarding the openness of the prices of apartments. The new regulations impose the obligation to run websites with current information about the prices of the offered premises on developers. Prices are to be published from the beginning of sales until its completion, and all changes must be recorded and archived every 24 hours.
The buyer will be able to compare the price history and, in case of discrepancy, demand sales at a more favorable price. For lack of transparency or hiding information about costs, developers may be fined up to 4 percent. annual turnover, imposed by UOKiK.
The changes are aimed at increasing the transparency of the housing market and better protection of buyers of premises against the so -called Patodeweloper and unfair sales practices.
