The American court ordered the American Airlines airline a payment of $ 13.2 million compensation to a passenger who suffered a stroke during a flight from Miami to Madrid. According to the court, the service did not provide him with adequate help.
The dramatic event occurred in November 2021 on board the American Airlines aircraft during a flight from Miami to Madrid. One of the passengers, Jesus Plasencia, suffered a vast stroke. He was accompanied by his wife, who was the first to draw attention to the service to the deteriorating state of the man. Despite the alarm signals, the crew did not take appropriate actions, which – as the court later said – had a key impact on the tragic health effects.

As the Paddle Your Own Kanoo portal reports, it all began before the start, when Jesus appeared with problems speaking and keeping the phone in his hand. Then the man’s wife called a flight attendant, but at that moment the symptoms subsided, and the service was limited to a warning about possible difficulties in the event of a again deterioration of the condition during the flight. The captain was also called, who assessed that a man could continue his journey.
The situation deteriorated about 90 minutes after the start, when Plasencia had serious problems with movement, which one of the flightngers noticed, but no intervention was taken. It was then that there was a stroke. It wasn’t until an hour before landing that the doctors were called from passengers who gave basic help and diagnosed stroke. Although emergency services were waiting at the airport in Madrid, the man’s health was irreversible.

The effects on the victim were dramatic. The stroke caused a permanent damage to health. Jesus Plasencia is not able to walk, speak, write or function independently. Requires 24 -hour care and intensive treatment. For this reason, his wife and family decided to appear against the American Airlines. They argued that the lack of reactions and actions in accordance with the procedures from the service led to deepening the health effects that could be partially avoided.
The airlines defended themselves, indicating that it was the decisions of the marriage itself, including the lack of consent to leave the plane at the first symptoms, contributed to the further development of events. The court, however, assessed that it was the neglect of service that were crucial and constituted a violation of the Montreal Convention, regulating the responsibility of carriers in such cases.
Ultimately, the court recognized the responsibility of American Airlines in 72.5 percent and ordered compensation in the amount of $ 13.2 million, or about PLN 48 million.
