The mobstor ceases to be only a digital portfolio of documents. The Ministry of Justice announces new functions that can completely change the way of using land and mortgage registers and the National Court Register.

The Ministry of Justice is working on a draft amendments in the Act on Land and Mortgage Registers and the Mortgage and the Act on the National Court Register. Deputy Minister Arkadiusz Myrcha is responsible for the project. As stated, the document was entered on Friday in the list of government’s work and is part of the extensive deregulation activities.

The project assumes the possibility of collecting electronic documents from central land and mortgage registers. Users of the ICT system CI KW will be able to download copies, extracts from the land and mortgage registers and certificates of their closure – all with the power of documents issued so far by the court. – Documents provided by the central information of the land and mortgage registers for independent printing via the ICT system before the date of entry into force of the Act, they will retain the power of documents issued by the court, if they have features enabling their verification – the list of legislative works was included in the list of legislative work.

Land and Mortgage Register and the National Court Register by PESEL number

One of the most important elements of change is the extension of the functionality of the mobstor application. Thanks to the project, users will be able to search for free data in the land and mortgage register by PESEL. The application is also to allow access to data from the National Court Register regarding entities entered in the register – from entrepreneurs to foundations, associations and independent public healthcare facilities.

The proposed provisions provide that data from the National Court Register will be made available to the extent regarding entities related to the User via the PESEL number. This will include Information about entries in the register of entrepreneurs or associations, as well as about initiated matters and changes made in the ICT system.

When will they come into force?

Extending the functionality of the application will require a change in the Regulation of the Council of Ministers of July 2023, regarding the scope of data and public registers served by the mobile. As planned, the new regulations will enter into force on March 31, 2026. This term results from the assumptions of the project “Development and increasing the availability of court registers – EKS and ECW”, implemented as part of the National Plan of Reconstruction and Increased immunity.

The planned date of adopting the project by the Council of Ministers is the third quarter of 2025. This means that in the coming months consultations and further work on the Act will begin, which will introduce revolutionary changes in the access of citizens to land and mortgage registers and data from the National Court Register.
