The new regulations will release entrepreneurs from the obligation to store paper reports to ZUS. The ministry wants to limit bureaucracy.

The Ministry of Family, Labor and Social Policy plans to significantly simplify the regulations for entrepreneurs. Currently applicable regulations impose on the contribution payers the obligation to store for five years paper versions of social security applications if they were sent to ZUS electronically. This requirement results from art. 36 para. 8 of the Act on the Social Insurance System.

Change in the regulations

The new bill, published on the website of the Government Legislation Center, assumes the liquidation of this obligation. As noted in the justification, the storage of physical documents with the signature of the reported person is considered unnecessary, because these data are already saved in both ZUS and payers themselves. This state of affairs means that separate archiving loses its meaning.

The authors of the project emphasize that the Social Insurance Institution also does not see contraindications to resigning from this requirement. According to ZUS, the change will not negatively affect the implementation of statutory tasks, and at the same time contribute to reducing bureaucratic burdens for entrepreneurs. This means facilitating business activity and reducing the costs related to the collection of paper documentation.

Transitional regulations

The project also provides for a transitional provision. On its basis, entrepreneurs who were obliged to store written applications with a signature before the entry of new provisions will be released from this obligation from the date of entry into force.

The ministry proposes that the law should become effective after 14 days from its announcement. If the project is adopted, entrepreneurs will be able to manage the application documentation faster and easier without collecting paper versions.
