The idea of covering the terrace seems innocent. But it’s a trap
Coffee or breakfast on your own terrace is the dream of many Poles. But when it rains, an uncovered terrace is not the same as a covered one, right? When will the office decide that this is unauthorized construction?
Poles excel in arranging terraces. Television also promotes this when it shows quick metamorphoses of home terraces. During them, furniture or plants are often changed, but we are unlikely to see the construction of a roof in interior design programs. Why?
Because in many cases it cannot be resolved within a few days. And it’s not about the construction itself, which is not particularly complicated. These are issues related to obtaining a building permit, which cannot be omitted.
Roofing the terrace without permission only after meeting the conditions
It all depends on the terrace area that we want to cover. According to the applicable construction law, there are only three circumstances in which you do not need to apply for a building permit in advance:
- when to cover the terrace (shed)does not exceed an area of 35 m22and within 500 m2there are no more than two outbuildings, garden sheds, tool sheds, garages or other sheds on the plot,
- when to cover the terrace, porch or conservatorydoes not exceed an area of 35 m22and for 500 m2there are no more than two objects from this category per plot,
- when the roof is made over a terrace with an area exceeding35 m2Butthe roof area will be no larger than 50 m2.
In these three cases, only notification to the competent architectural and construction administration authority is required. So where?
Reporting the construction of a roof is easier than obtaining a building permit
If the construction of a roof is a reconstruction of a building, it is necessary interfere with the structure of the house in a significant way, then it is necessary to report the construction of a terrace roof in the district office. If there is a risk that the roof will affect the stability of the building, then the situation must be assessed by an expert. He will issue an opinion on the basis of which you can obtain a building permit.
However, if the construction of a roof is simply part of the renovation, in such a situation there is no need to report the construction of the roof. This depends primarily on the individual interpretation of the regulations, which, of course, in case of problems will need to be proven before the appropriate authority.
Who wants to drink coffee in peace on a covered terrace? constructed in accordance with the law, may report the roofing even if it is not an obligatory activity. The report itself is not a complicated process and will often allow you to enjoy the area more peacefully.
