The government is preparing a revolution for renters. New area limits and high fines are intended to curb pathologies.
The government is preparing changes to the rental of real estate for periodic residence purposes. The new regulations are intended to limit the creation of the so-called employee hotels in single-family houses and introduce penalties for owners who do not fulfill their obligations related to changing the use of the building.
The Ministry of Development and Technology indicates that the problem concerns towns where buildings are being built for a large number of people coming to work. According to local government representatives, some of such properties operate in conditions that do not meet sanitary and fire safety requirements.
Rental of real estate for temporary residence purposes with new limits
The ministry announces that in single-family buildings only 30 percent area will be able to be used for temporary residence purposes. Exceeding this limit will require obtaining a decision regarding a change in the use of the building.
Deputy Minister of Development and Technology Tomasz Lewandowski informed during the meeting of the Joint Commission of the Government and Local Government that the regulations had already been prepared. He emphasized that owners who want to run an employee hotel will have to apply for a change in the use of the property.
Fine up to PLN 10,000. PLN for no change in use
The Ministry of Energy and Technology also plans to introduce financial penalties for owners who do not comply with the new rules. Using a building without the required consent to change its use will be subject to a fine of up to PLN 10,000. zloty. The fine may also be imposed again if the owner still fails to comply with the regulations.
The changes are intended to reduce disputes related to the use of single-family buildings as collective accommodation. The Ministry points out that the activity of periodic room rental may affect, among others: on fire safety and hygienic and sanitary conditions.
The NSA has drawn attention to the problem before
The text recalls the judgment of the Supreme Administrative Court of February 15, 2018 regarding an employee hotel located in a commercial and residential building. The Supreme Administrative Court then found that a change in use may occur not only after construction works have been carried out, but also through the actual use of the facility in a different way.
The court also indicated that collective housing buildings must meet certain technical requirements related to, among others: with safety and sanitation. If you run a business without the required notification, it may be necessary to carry out a legalization procedure.
The government wants new regulations to be introduced quickly
The Ministry emphasizes that various legislative paths are being analyzed that will allow for faster implementation of new regulations. Both a government project and a parliamentary initiative are being considered. Local government officials declare cooperation in developing detailed solutions.
Representatives of the local government point out that the problem also concerns the division of single-family houses into a large number of residential premises. According to them, this affects the functioning of municipal infrastructure and causes increasing problems in municipalities.
