The garage will be able to be placed right next to the fence. An important change from September 20

Plot owners will be able to build larger garages and outbuildings directly next to the property line. The Ministry of Development and Technology is working on changing the technical conditions, which is to enter into force on September 20, 2026. The new regulations provide for an increase in the existing limits on the length and height of such facilities.

Currently, in single-family and homestead buildings, a detached garage or outbuilding with a length not exceeding 6.5 m and a height of up to 3 m can be built at the border of the plot. After the changes, the limits will increase to 7 m and 3.5 m, respectively.

The garage at the border of the plot could be larger

The project assumes that a larger facility can be located directly next to the plot boundary or at least 1.5 m from it, provided that the wall facing the neighboring property does not have windows.

The change is intended to make it easier for investors to build larger garages and sheds without having to maintain standard distances. These are currently at least 4 m if the wall facing the boundary has windows or doors, and 3 m if it has no such openings.

When can a garage be closer than 3 meters?

The current regulations already provide for exceptions. In single-family and homestead developments, a detached garage or outbuilding may be located right next to the border or 1.5 m from it, if it meets the dimensions requirements and there are no windows or doors in the wall on the neighbor’s side.

This solution is also permissible on a plot up to 16 m wide. The garage can also be located directly on the border if it is adjacent to an existing building on the neighboring property and its height complies with the provisions of the local plan or the decision on development conditions. The possibility of moving the building closer to the border may also result directly from the local plan.

Not every garage will benefit from the new facility

The National Council of the Chamber of Architects of the Republic of Poland proposed extending the regulations also to garages that are not detached and constitute an extension of a single-family house. However, the Ministry of Development did not accept this proposal.

This means that although the permissible dimensions of garages and outbuildings built near the border are to be increased, the new solution will not cover garages that are part or extension of a house. The planned regulations are to enter into force on September 20, 2026.
