The CJEU sentence was passed. Poland will pay a huge penalty

Due to the fact that Poland was late with the implementation of the Copy Rights Directive in the Single Digital Market, this must be given the consequences.

According to the CJEU ruling, which was made on Thursday (June 4) in Luxembourg, we will have to pay 8.3 million euros (about 35 million zlotys). A complaint about the European Commission (European Union executive body) lodged against Poland.

Poland has implemented the EU directive with a nearly 3-year delay

As Interia reminds, the time to implement the new EU law was determined – Poland could make changes to June 2021. But she did it only in 2024, nearly three years after the deadline.

The directive was undertaken in 2019. It treats the change in the rules for publishing and monitoring internet content.

Due to the fact that Poland delayed its implementation, the EC initiated the proceedings (during the rule of the United Right). However, Poland appealed to the Directive to the CJEU. However, the tribunal rejected this complaint a year later – in 2022.

And although in the meantime the complaint of the directive was implemented by the Republic of Poland, the EC, whose chairwoman is Ursula von der Leyen, did not resign from the complaint regarding the imposition of a penalty.

Poland justified itself before the judges of the Tribunal that it had to carry out public consultations before the introduction of EU law. In addition, it was a pandemic period, which hindered the task. The CJEU apparently did not find it sufficient regarding dismissal of the sentence.

In connection with the judgment of the EU judicial institution based in Luxembourg, Warsaw must now bear the consequences, i.e. pay a penalty of EUR 8.3 million. In terms of the Polish currency, it is over PLN 35 million.
