As Pasieczyńska pointed out, the inspections include, among others Analysis of e-plain content in electronic cigarettes, cartridges and spare reservoirs. Until now, KAS has carried out over 90 customs and tax inspections in companies dealing in the production and trade of e-cigarettes.
-In the case of 700 out of 772 samples (90.6 percent), the examination was exceeded by the permissible capacity of a disposable e-cigarette tank, cartridge or spare container. Exceeding standards means that the products are inconsistent with EU and national regulations and, as considered dangerous, should not be on sale at all – emphasized asp. Pasieczyńska.
1295 samples were taken in the course of control activities, of which 772 were tested. The results are alarming – as much as 90.6 percent. of them exceed the permissible standards.
E-cigarettes incorrectly taxed
In 74 cases, the National Tax Administration has detected that the actual e-flow content in the tested e-cigarettes was higher than declared. This means that these products were incorrectly taxed with excise duty, which resulted in losses for the state budget.
Therefore, KAS initiates procedures to determine and collect the excise tax due. In addition, tax criminal proceedings will be conducted towards entities responsible for irregularities.
The disclosed irregularities also include violations of the provisions of the Act on health care against the consequences of using tobacco and tobacco products. E-cigarettes and spare containers should meet certain requirements-their failure to meet them may result in a fine of up to 200,000. PLN, limitation of freedom or both these penalties together.
