Missed advice may have serious legal consequences, especially in the case of official letters. Find out how long you have to collect your shipment and whether someone can pick it up for you.

Everyone sometimes fails to pick up a notice at the post office. For various reasons. Going on holiday, working away from home, a longer hospital stay or simply forgetfulness. Many of us are busy people every day, busy and busy with our duties. Not everyone remembers to check their mailbox regularly. Especially when we are not expecting any important shipment.

Advice. How long for collection?

You have a total of 14 days to collect your registered shipment. After the first delivery attempt, the postman leaves a notice, and after seven days, if the parcel has not been collected, you receive a second notice. The next seven days are the final collection time, after which the parcel is returned to the sender.

Missed notice. Possible consequences

If we do not collect an “ordinary” parcel, e.g. a gift from friends, the parcel will simply return to the sender and we will not suffer any major consequences. The situation changes if the missed advice is accompanied by a letter from the court, bailiff or police. In the case of official letters, failure to collect them after two notifications is tantamount to their delivery. And this is very important information. This means that from the legal point of view, the addressee had the opportunity to read the contents of the shipment, even if he did not physically collect it.

  • Correspondence from a bailiff or creditor: In the case of correspondence related to debt collection or enforcement, failure to collect the advice may result in the continuation of the proceedings without the debtor’s knowledge, which may lead to bailiff enforcement or seizure of property.

  • Letter from the police, summons for questioning: If you do not answer the summons and do not appear for questioning, the police may request that you be forcibly brought to the police station. This is especially true when you are a witness or suspect in an important case. Therefore, the police may knock on your door and take you to the police station under duress. Failure to cooperate with the police may result in further action, such as increased criminal prosecution, especially if the case involves serious allegations.

  • Letter from the court: In civil cases, if you do not respond to the summons and do not appear at the hearing, the court may issue a default judgment, which may be unfavorable to you. Not participating in the case means that you lose the opportunity to present your arguments. Failure to receive a court decision on time may also result in the loss of the right to appeal or submit an application for reopening the proceedings.

Can someone collect the notice on my behalf?

In most cases, someone with the same residential address can collect the parcel. When it comes to official letters, a power of attorney is required. Powers of attorney are available in three variants:

  • Permanent – ​​cost PLN 26, for people who regularly need help collecting parcels.

  • Periodic – cost PLN 8 per month, useful e.g. during trips.

  • Disposable – cost PLN 6, useful for collecting one parcel.

Powers of attorney are particularly useful for people living abroad or sick who cannot collect the parcel in person.
