Plot owners will get more freedom. The garage could be bigger

Plot owners will be able to build larger garages and farm buildings close to the border. The limits are to increase to 7 m in length and 3.5 m in height.

The rules for locating buildings on a plot depend primarily on whether the wall facing the neighboring property has windows or doors. If there are such openings, the building should be at least 4 m from the boundary. In the case of a wall without windows and doors, the minimum distance is 3 m.

However, there are exceptions to these rules. In single-family and homestead developments, a detached garage or outbuilding may, in certain cases, be located directly at the border of the plot or at a distance of at least 1.5 m from it. Currently, this applies to objects up to 6.5 m long and not exceeding 3 m high.

Garage at the border of the plot. The limits are to increase

The Ministry of Development and Technology is working on amending the regulation regarding the technical conditions that buildings and their location should meet. One of the approved changes provides for an increase in the permissible dimensions of detached garages and outbuildings built close to the border.

The maximum length of such an object is to increase from 6.5 to 7 m. The height limit will also change – instead of the current 3 m, it will be 3.5 m. This applies to objects located directly next to the border or at least 1.5 m from it.

Narrow plots have special rules

The regulations also provide for an exception for building plots 16 m wide or less. The outbuilding or garage can then be located with a wall without windows and doors, directly next to the border or at a distance of 1.5 to 3 m.

The building may also be located directly on the border if its wall is adjacent to an object located on an adjacent plot. However, its height must meet the requirements resulting from the local development plan or the decision on development conditions.

The local plan may allow for construction closer

The possibility of locating the building closer to the border may also result from the local plan. This means that the basic distances of 3 or 4 m are not the only values that need to be taken into account when planning investments.

The amendment is intended to extend one of the exceptions already in force by increasing the permissible dimensions of objects. This does not mean, however, that more lenient rules will apply to every type of garage.

Not every garage will benefit from the change

The National Council of the Chamber of Architects of the Republic of Poland proposed that the term “detached” be removed from the regulations. This would allow the new solution to be used more widely, also in relation to garages adjacent to single-family houses.

The ministry did not accept this demand. However, the ministry agreed to increase the length and height of detached garages and outbuildings. According to the material, the regulation is to enter into force on September 20, 2026.
