Entrepreneurs taking advantage of the maximum energy price must remember an important deadline. Lack of documentation may mean higher bills.
Entrepreneurs who benefited from the maximum electricity price in the second half of 2024 must complete certain formalities. Otherwise, they may be charged higher energy costs. The key deadline is the end of June.
After the outbreak of the war in Ukraine and limited supplies of raw materials from Russia, the government introduced maximum electricity prices. In 2022, the limit was PLN 693 per megawatt hour, while in 2024 for households it was reduced to PLN 500 per megawatt hour.
Electricity prices for entrepreneurs and de minimis aid
According to the Ministry of Climate, the decline in wholesale energy prices has opened the way to new tariffs. After the current maximum price expires, individual customers will benefit from lower rates from October 2025. The new tariffs are to be significantly lower than the current average of PLN 622.8 per megawatt hour.
In the case of micro, small and medium-sized enterprises, the situation is different. Companies benefiting from the maximum energy price of PLN 693 per megawatt hour in the second half of 2024 must submit an appropriate declaration to their energy supplier by June 30, 2025. This is necessary because the maximum price was considered de minimis aid.

The required documents can be submitted in several ways. Entrepreneurs can complete the form and submit it electronically, send it by post or deliver it in person to the customer service point of their energy supplier.
The choice of the form of submitting documents remains with the entrepreneur, but the most important thing is to meet the applicable deadline. Only then will it be possible to maintain preferential energy settlement conditions.

Failure to submit the required declaration means loss of the right to preferential rates. In such a situation, the energy seller will adjust the settlement for the second half of 2024. Instead of the maximum price, the entrepreneur will be settled according to the prices resulting from the concluded contract.
This is not the only consequence. In addition to higher energy costs, statutory late interest may also apply. Therefore, entrepreneurs who benefited from maximum energy prices should remember to submit the required documents on time.
