The new construction law introduces a “yellow card” for investors. In some cases, they are even threatened with demolition.
It has been in force since the beginning of the year new construction law 2026which introduces significant changes for investors. The most important novelty is the so-called the “yellow card” system, i.e. a formal warning to people who do not comply with the permit conditions during construction.
The new regulations assume that instead of immediately suspending work, the investor will receive a request to restore compliance of the investment with the project. This is one of the most important changes introduced by the legislator.

If irregularities are detected during the investment, the investor will receive a warning and will have 60 days to remove them. After this time, inspectors will check whether the construction has been adapted to applicable regulations and the design.
If the deficiencies are corrected, the case will be closed. Otherwise, construction supervision may suspend the work and initiate further proceedings.

In more serious cases, the consequences can be much more severe. The new regulations provide for the possibility of ordering partial demolition of the facility.
Detecting irregularities at a late stage of investment may be particularly problematic. Then their removal may mean the need to demolish a significant part of the building.

The new regulations apply not only to large investments, but also to the construction of single-family houses. This means that people building for their own needs must also carefully follow the conditions of the permit.
An additional difficulty is the inability to extend the deadlines for removing irregularities. Investors must meet the deadline.
New construction law 2026 and legalization of unlawful acts
The amendment also provides for simplification of the procedure for legalizing unauthorized construction. This applies to situations where at least 10 years have passed since the completion of construction.
This means that in such cases it will be possible to regulate the status of the building more easily, without having to go through complicated procedures.
