New gardeners often don’t know about this. Breaking the rules may result in the loss of your plot

Allotment holders using family allotment gardens must comply with the provisions set out in the ROD regulations. They concern, among others: building fences, planting hedges and using the infrastructure belonging to the association. PortalSamorządowy.pl reports on the matter.

According to the regulations, plot users cannot build new gates or wickets in the external garden fence on their own. This infrastructure is the property of the association running the ROD, therefore any interference is prohibited.

A hedge requires the neighbor’s consent

The regulations also specify the rules for planting hedges. Allotment holders may separate their plot from the neighboring plot with a hedge only after obtaining the written consent of the user of the neighboring plot.

Such a hedge cannot exceed 1 meter in height. The same limit applies at the border of the plot with an alley or internal road. Higher hedges, up to two meters high, are only permitted on the border of a family allotment garden, provided they do not exceed the external fence.

What are the limits?

The ROD regulations state that the fence of the plot cannot be higher than 1 meter and should have an openwork structure. It is also prohibited to install barbed wire or other sharp elements that could pose a threat.

Restrictions also apply to car traffic. As a rule, it is not allowed to enter the ROD area with passenger vehicles or to park outside the designated spaces. The exceptions are situations related to the delivery of building materials, fertilizers or other heavy loads – under the terms specified by the garden management.

There are consequences for breaking the regulations

Failure to comply with the regulations may have serious consequences. The management board of a family allotment garden has the right to terminate the allotment lease agreement with a person who persistently violates applicable regulations. The detailed procedure in such cases is specified in the statute of the Polish Allotment Gardeners’ Association.
