Municipalities are preparing changes that will affect plot owners. Experts are sounding the alarm

Plot owners have less and less time. New regulations may determine whether it will be possible to build in the future.

By August 31, 2026, all municipalities in Poland are to adopt general plans. The new document will replace the study of conditions and directions of spatial development and will become the basis for issuing decisions on development conditions and adopting or amending local spatial development plans.

Experts emphasize that the general plan will affect more stages of the investment process than before. In practice, its provisions will influence further decisions related to the possibility of implementing construction investments.

General plan of the commune. Why is it worth submitting comments?

According to experts, residents should be interested in the document already at the stage of its preparation. The 2023 spatial planning reform has expanded the possibilities for public participation in the procedure, and municipalities are obliged to conduct more forms of public consultations.

Residents can submit requests and comments regarding their properties. This may be important, among others: in a situation where new buildings appeared in the vicinity of the plot or circumstances affecting the possibility of development have changed. After the adoption of the general plan, the only option left will be to file a complaint to the administrative court.

Lack of a plan may mean investment paralysis

The expert points out that municipalities are aware of the consequences of failing to meet the statutory deadline. Where there are no local spatial development plans, investment paralysis may occur.

In such a situation, it will not be possible to obtain a decision on development conditions, and the adoption of new local plans or changes to existing ones will be very limited. Without these documents, the plot owner will not receive a building permit.

The plan itself does not give the right to build

Experts emphasize that the mere fact that a plot of land is located in a development zone does not automatically mean the right to build a house. The final purpose of the property will be determined only in the local development plan.

At a later stage, provisions regarding, among others, environmental protection or distance from rivers and lakes. This means that even a plot located in a multi-functional zone with single-family residential buildings does not guarantee the possibility of development.

Experts advise property owners to keep up to date with information published by municipalities, especially in the Public Information Bulletin. It is at the stage of creating a general plan that you can effectively express your expectations regarding the future of the plot.
