KSeF is off to a painful start. The system couldn’t handle it
The National e-Invoice System was launched on February 1, but problems appeared the next day. Login failure and pressure on companies caused chaos.
The day after the launch of the National e-Invoice System, the first serious difficulties appeared. On Monday, February 2, many users were unable to log in to the system. As confirmed by the Ministry of Digitization, the cause was a failure of the Trusted Profile, caused by very high interest in access to the new version of KSeF.
The Ministry of Digitization announced on social media that mass attempts to log in to KSeF 2.0 slowed down the operation of the Trusted Profile. The announcement noted that there may be temporary access problems, and people using public administration services for other purposes should, if possible, use alternative methods of identification.
KSeF has started, but only for the biggest ones
From Sunday, February 1, the obligation to issue invoices in KSeF applies to the largest VAT payers. In just two months, many more companies will join this group. Thanks to the system, the tax office will gain access not only to information about who sold to whom and for how much, but also to the full content of invoices.
Although the system is not yet universal, all trade participants – entrepreneurs, public institutions, offices and local governments – must already know how to collect invoices issued in KSeF. Consumers, however, in most cases will continue to receive documents in their current form, i.e. paper or electronic. The Act allows for the issuance of consumer invoices in KSeF, but requires prior agreement on the method of submitting them.
Exceptions and old rules
The following still remain outside the system: highway receipts, railway tickets, cash register receipts – also those considered as invoices up to PLN 450 – and the so-called fiscal invoices. This is important, among others: for gas station customers. Orlen announced that at least until April it will issue fiscal invoices outside KSeF for business customers, regardless of the transaction value, with the exception of fleet sales.
Pressure on smaller contractors
Although KSeF is not yet applicable to everyone, some large companies are trying to force its use on smaller business partners. Annexes to contracts include provisions making payment conditional on receipt of a structured invoice or postponing the beginning of the payment deadline to the moment of assigning the KSeF number. There are also requests to send visualizations of invoices or clauses transferring the risk of possible questioning of VAT deduction to suppliers.
