An inconspicuous garden shed can end up costing you a lot. If the structure is closer than 1.5 m from the plot boundary, officials treat it as unauthorized construction. The inspections are meticulous – inspectors measure distances with centimeter precision. The consequences of mistakes can be severe: legalization costs 5,000. PLN, and for carrying out works contrary to the regulations there is an additional penalty of PLN 5,000. PLN fine. In total, the owner can pay up to PLN 10,000. zloty.

Location variants

The regulations allow two location options: the shed can be placed directly next to the border or at a distance of at least 1.5 m. All “in-between” settings are prohibited – they are intended to prevent situations in which the owner would have to enter someone else’s property to repair the wall. Moreover, a distance of 1.5 m is only allowed if the local development plan allows it. This is a common trouble spot during inspections: owners don’t always check what exactly local regulations stipulate.

Even if the shed is located “at the junction” of the border, formalities do not disappear. Such a facility requires notification, and the office may request a building permit. It should be remembered that the application is submitted before the commencement of works – only after 21 days without objections it is considered accepted. Starting work earlier may result in the investment being classified as unauthorized construction, which means additional fees and procedures. As the quoted statement reminds, officials have no mercy for violations and treat irregularities rigorously.

The size and parameters of the structure are also important. If the shed exceeds 35 sq m. area, a full building permit will be required, not just a notification. Additionally, for every 500 sq m A maximum of two such structures can be built on a plot of land. The structure itself must be permanently connected to the ground – even if it stands on cement blocks. This is another criterion that is sometimes verified during the inspector’s visit.

Certain exceptions

Not all facilities require completing the full formal path, but exceptions are strictly defined. Without reporting you can build, among others: some sheds up to 35 sq m. with a span of up to 4.80 m, small container dryers up to 21 sq m. or gazebos. Agricultural shelters up to 150 square meters are also exempt from some obligations, provided they meet the conditions arising from the regulations. In practice, however, this means that most standard garden sheds still require notification – especially if they are located next to a boundary or if the local plan imposes additional restrictions.

The summary is simple: before you order a ready-made tool shed or start building a small utility area, check the local plan, plan the distance from the border (0 m or ≥1.5 m), assess whether an application is enough and submit it in advance. Keeping the 21-day deadline for tacit acceptance of the notification and proper selection of construction parameters will allow you to avoid the “illegal construction” stamp and a bill of up to PLN 10,000. zloty.
