Municipalities have until the end of August to adopt general plans. Plot owners are submitting applications en masse to maintain the possibility of building a house.

Local governments have until August 31, 2026 to adopt general plans. At the same time, offices are faced with a sharp increase in the number of applications for decisions on development conditions, i.e. the so-called “wuzetek”.

In this way, plot owners want to secure the possibility of building a house before the new rules come into force. In some communes, the number of documents submitted increased from several hundred to even 1,000 percent.

General plans will determine development options

The study of conditions and directions of spatial development is to be valid until the end of August. Originally, the new regulations were to enter into force on July 1, 2026, and even earlier the date of changes was set for December 31, 2025.

General plans are to indicate in which areas residential development will be allowed and where it will be excluded. Their provisions may therefore be of great importance for the future value of the property.

The area of ​​complementing the development will be crucial

The situation of plot owners for whom no local development plan applies is particularly important. After the changes come into force, obtaining a decision on development conditions will only be possible if the property is located in the development area.

If the plot is not included in such a zone, the owner may lose the opportunity to obtain a new “wuzetka”, and thus build a house under the existing rules.

Offices cannot keep up with processing cases

The growing number of applications causes congestion in municipal spatial planning offices. Confederation MPs pointed out that due to staff limitations, some proceedings may not be initiated before the adoption of general plans, even though the documents were received early enough.

In an interpellation addressed to the Ministry of Development and Technology, it was indicated that local governments may not be able to handle all cases on time.

The government does not plan additional aid

Deputy Minister of Development and Technology Tomasz Lewandowski announced that the ministry is not considering additional financial or human support for municipalities. Local governments will therefore have to handle the increased number of proceedings with their own resources.

The deputy minister also assured that decisions on development conditions issued before the entry into force of the new regulations will remain valid. For plot owners, this means that the legally binding “wuzetka” will still protect the possibility of implementing the investment.
