Do you have a ROD plot? You may even lose your garden for such a hedge
Not everything is allowed on ROD plots. The regulations specify the height of hedges, require neighbor consent and provide for strict consequences.
Allotment holders using family allotment gardens must comply with the rules set out in the ROD regulations. They concern not only the use of the plot, but also the construction of fences, planting hedges and entering the garden by car. Breaking the regulations may even result in termination of the plot lease agreement.
Fences on plots
The regulations prohibit independent interference with the external fence of the family allotment garden. Allotment owners cannot build new gates or wickets because this infrastructure belongs to the ROD association. However, the management may decide to close the gates to ensure safety, but must guarantee free access for emergency services.
The regulations also clearly define the rules regarding fencing of individual plots. The fence cannot be higher than 1 meter and should have an openwork structure. It is prohibited to install barbed wire or other sharp elements.
Particular restrictions apply to hedges. Separating a plot from a neighboring plot with a hedge is possible only after obtaining the written consent of the user of the neighboring plot. Such a hedge cannot exceed 1 meter in height. The same limit applies at the border with an alley or internal road. Higher hedges, up to two meters high, are permitted only on the border of the allotment garden, provided that they do not exceed the ROD fence.
Entry possible
The regulations also limit the entry of cars into the garden. As a rule, passenger cars are not allowed to enter or park outside the designated spaces. The exception applies to vehicles delivering construction materials, fertilizers or other necessary items to the plot. In such cases, the rules established by the ROD management board apply, which may determine, among others: route or permissible vehicle weight.
The Local Government Portal reminds that failure to comply with the regulations may have serious consequences. The management board of a family allotment garden has the right to terminate the allotment lease agreement with a person who breaks the applicable rules. The detailed procedure in such cases is specified in the statute of the Polish Allotment Gardeners’ Association.
