The project envisaging the PIP reform is controversial within the government. The head of the Ministry of Labor, Agnieszka Dziemianowicz-Bąk, commented on the critical voices.

The draft bill prepared by the Ministry of Family, Labor and Social Policy providing for the reform of the National Labor Inspectorate (PIP) has raised critical voices among entrepreneurs, but, as it turns out, it also raises reservations in the government.

The idea of ​​counteracting the phenomenon in which someone who is a de facto employee is forced to sign a civil law contract is right. However, we must clarify the solutions so as to protect people who need protection, but also so that inspection tools cannot lead to the annihilation of the entrepreneur. – said Maciej Berek, Minister of Supervision over the Implementation of Government Policy, in an interview with Money.pl.

The minister emphasized that it is necessary to find a solution that balances two perspectives – protection of individual persons and a sense of security in running a business.

Certainly, a project in which a single official could decide on the existence or non-existence of companies cannot gain acceptance. If we accepted the retroactive effects of the decision – tax, ZUS – it would give the official power that he should not have. – Berek emphasizes.

PIP reform. The minister responds to criticism

The most important change in the project provides that PIP will be given the right to issue administrative decisions on the transformation of civil law contracts into full-time positions. And with immediate effect. Decisions in these matters are to be subject to immediate enforcement in terms of the effects of labor law provisions on the establishment of an employment relationship and tax and social security obligations arising from the date of their issuance.

The reform of the National Labor Inspectorate will protect both employees and entrepreneurs against unfair treatment and unfair competition. We do not change applicable labor law. It should be complied with today in exactly the same way as it will be complied with after the Act enters into force. The National Labor Inspectorate will be able to enforce this law more effectively. Just that and that’s it – emphasizes the head of the Ministry of Labor.

Labor law is law. The vast majority of employers understand and respect this. And where things are different, the state must react – she added.
