Controls in municipal apartments. Removals are being prepared!

Municipalities exercise new rights to verify the income and property of tenants of municipal apartments. Once every 2.5 years, you need to expect mandatory control.

The Ministry of Finance and Economy is working on new regulations regarding the verification of tenants of municipal apartments. Officials will be able to more accurately check the financial situation of people applying for municipal apartments and current tenants.

Some residents have already received letters on the control and verification of income and property. Cities are required to carry out such activities not more than once every 2.5 years.

Poland still has too few apartments per 1000 inhabitants

According to various estimates from the mid -2025, in Poland there is a lack of between 300 – 400 thousand. up to 1.5 – 2 million apartments. There are about 420 apartments per 1000 inhabitants, which is a lower indicator than in many Western countries (about 541 apartments per 1000 inhabitants).

The fundamental demand for apartments in Poland will be satisfied between 2027 and 2030, with it most likely it would take place around 2028 – forecast Alior Bank experts in the report “What awaits the Polish housing market? Development scenarios until 2040”.

Control of contracts concluded before 2019

It is not surprising that city apartments are increasingly desirable, and it is more and more hot around their rent.

Currently, office employees have the right to check whether a municipal apartment tenant meets income criteria, but only if the lease agreement was concluded after April 21, 2019. People who have signed a contract earlier are not covered by such a verification obligation.

After changes in the law, income control will be carried out at least once every 5 years and will cover all contracts – including those before 2019. New income thresholds will be introduced, which are to be controlled on the basis of average income from the 12 months preceding the verification.

All tenants will also have to make statements about the lack of a legal title to other real estate in the same or neighboring town. If during the inspection it turns out that the income increased, the rent will also be raised or the tenant will have to look for a dwelling in the free market.

Officials will be able to refuse the housing allowance in accordance with the law if the number of people actually living is smaller than declared, and after the tenant’s death it will be necessary to conclude a new contract by persons remaining in the premises. Their income will be thoroughly verified before.

The bill should be adopted by the government in the second quarter of 2026. The new rules will come into force at the earliest at the end of next year.
