Compulsory photovoltaic from 2026. The EU has changed the rules and there are penalties

It is true that from 2026 photovoltaics will be mandatory on the roofs of new buildings in the European Union countries. But is it in Poland?

The European Union introduces the obligation to install photovoltaics on the roofs of new buildings. The first changes are to apply from 2026.

The new regulations are to apply to new public, commercial and residential buildings.

Poland obliged to implement the directive

The directive on the energy efficiency of buildings was voted by the European Parliament in 2024 and is to be implemented gradually:

  • from 2026 – new commercial and public buildings,

  • from 2029 – new residential buildings,

  • from 2030 – existing commercial and public buildings that will undergo thorough modernization,

  • From 2030 – all existing buildings of the public sector.

Poland is obliged to implement the so -called building directive, i.e. the directive on the energy characteristics of buildings. It is a legal act of the European Union aimed at improving the energy efficiency of buildings in member states. The main goal is to reduce energy consumption, reduce greenhouse gas emissions and promote renewable energy sources in construction.

There will be legal problems without a photo on the roof

Like other EU countries, Poland plans to introduce these requirements according to the schedule. “We note that in the context of residential buildings, the cited provisions apply only to new buildings, not used buildings,” emphasized the Ministry of Development and Technology in Money.pl

The directive does not provide for direct penalties imposed on the investor for the lack of photovoltaics, but provides for great difficulties.

“The building erected contrary to the provisions of the Regulation will not obtain a statement of the construction manager about the compliance of the construction building with a construction design or the terms of the building permit, which in turn prevents the notification of the completion of the construction of a building or an application for a use permit,” the ministry explained.

The directive on the energy efficiency of buildings is part of the wider strategy of the European Union to reduce dependence on fossil fuels. The buildings are responsible for over 1/3 of greenhouse gas emissions in the EU.
