Can you buy state land now? New regulations valid until 2036

The sale of state lands in Poland is very limited, although not completely impossible. In strictly defined cases, it requires the consent of the ministry. New recipes are being prepared.

State land in Poland is managed mainly by the National Agricultural Support Center (KOWR) and by the State Forests. The land resource on the KOWR board has about 1.32 million hectares. About 7.3 million hectares of groves, groves, forests and forests remain under the control of the State Forests.

The new draft amendment to the Act of 2016, published on the website of the Government Legislation Center, extends the lease for the next 10 years as the main form of using the land of the State Treasury agricultural ownership.

At the end of 2024, there were 1.32 million hectares in the hands of the state, of which as much as 1.044 million ha was leased – by 6.7 thousand. ha more than a year ago. Only in the first half of 2025 Kowr leased almost 37.7 thousand. ha

The current provisions allow the sale of land only until the end of April 2026, but only under strict conditions and with the consent of the Ministry of Agriculture, issued at the request of the General Director of the National Agricultural Support Center (KOWR). This procedure aims to prevent the concentration of agricultural land in private hands.

The new regulations will come into force from May 1, 2026.

Lease is an effective way to speculate

The Ministry of Agriculture is of the opinion that the lease of land is a favorable solution for the farmers themselves, who thanks to this do not have to engage large capital in the purchase of land. Instead, they can focus money on investments in farm development, which is important especially for smaller and medium -sized farms.

Farmers also see in this mechanism a way to stabilize access to land and protect against land speculation.

According to information from the Central Statistical Office (CSO) from the fourth quarter of 2024, which were published by the Agency for Restructuring and Modernization of Agriculture, the average value of arable land in Poland reached PLN 71,151. It is PLN 1,496 more than in the previous period.

However, there are significant differences in the prices of agricultural land between individual regions of Poland. In Greater Poland, the average price per hectare is PLN 95,393. At the same time, for the best soil classes, this price increases to around PLN 117,258. In the Lubuskie Voivodeship, the average price per hectare is PLN 41,486, and for the best quality land about 48 thousand. zloty.
