Work is underway on changes to the Spatial Planning Act. BCC calls for clear and well-thought-out regulations.

Work is underway in the Sejm on amending the Act on Spatial Planning and Development. The new regulations are intended to introduce corrections and deregulation in the system, which will fully enter into force in mid-2026, although some of the solutions are already in force now.

– The approaching date of entry into force of a massive reform of the spatial planning system causes more and more questions, concerns, but also ideas for corrections to the reform – noted Marcin Nosiński, chairman of the Business Center Club (BCC) Construction Committee.

Facilities for municipalities and investors or investment paralysis?

The amendment to the Spatial Planning Act introduces significant changes that have a significant impact on the work of local governments and investors. The existing spatial development studies will replace the general plans of municipalities, the adoption of which has been postponed until June 2026.

Experts emphasize, however, that not all municipalities will be able to implement new documents on time – lack of resources and overload with applications for development conditions may lead to investment paralysis.

They indicate that the new obligations imposed by the act cause anxiety both in offices and among investors who fear delays and complications in the spatial planning process.

BCC calls for a well-thought-out amendment

BCC emphasizes the need for thoughtful and coherent amendments to the regulations. In the position sent to the editorial office, he points out that the lack of uniform interpretation of regulations and the shortage of specialists in municipalities may slow down the investment process and hinder the implementation of statutory obligations.

– In the opinion of the organization, the amendment is a step in the right direction, but it still requires refinement to ensure the stability of the law and the efficient functioning of the spatial planning system – emphasize BCC representatives.
