From 2026, the bailiff will occupy a smaller part of the salary. The free amount will increase and the debt enforcement will last longer.

From the beginning of 2026, changes have come into force that will limit the enforcement capabilities of bailiffs. In connection with the planned increase in the minimum wage, the part of the remuneration that the bailiff may occupy. Thus, the recovery of creditors will become more difficult and the whole process will last longer.

The amount free of deductions

Execution of remuneration for work is one of the most common ways to recover debts. However, it is subject to rigid regulations that determine both the order and the limits of deductions. The so -called The amount free of deductions, i.e. the minimum sum that the employee must receive on hand. Its amount depends on the minimum wage, so each increase means that the bailiff can take less money.

The government proposed that from 2026 the minimum gross wage would be PLN 4806 and the hourly rate PLN 31.40. As a result, the amount free of deductions – with the basic tax deductible costs and without payments to PPK – will increase from PLN 3,510.92 (in 2025) to PLN 3605.85. This means that the bailiff will be able to take a smaller part of the debtor’s salary.

At the same time, other limits will also increase:
– 75% of the minimum wage will increase from PLN 2633.19 to PLN 2704.39,
– 90% of this amount from PLN 3159.83 to PLN 3245.27.

Alimenciars on different terms

It is worth noting that these rules do not apply to maintenance debts – here the deductions can reach up to 3/5 of the salary, without having to provide the employee with a minimum amount.

Although for employees it means higher income protection, for creditors – longer waiting for a refund. The increase in the minimum wage directly affects the pace of bailiff enforcement and may deepen the difficulties in recovery of receivables.
