Are you building a garage or shed? New regulations come into force from September 20

From September 20, 2026, changes to the regulations regarding the location of garages and outbuildings will come into force. The Ministry of Development and Technology will increase the permissible dimensions of objects that can be placed directly at the border of the plot or at a distance of at least 1.5 meters.

Currently, the regulations allow the construction of a detached garage or outbuilding on the border of the plot in single-family and farm buildings, if its length does not exceed 6.5 m and its height does not exceed 3 m. From September, the limits will be increased.

The garage at the border of the plot could be larger

After the changes, the maximum length of such an object will increase to 7 meters and the permissible height to 3.5 meters. The change was accepted by the ministry during work on amending the regulation on the technical conditions of buildings.

The new regulations will cover garages and outbuildings located directly at the border of the plot or at a distance of not less than 1.5 meters from it, provided that the wall facing the border does not have windows or doors.

Basic distances still apply

The rule remains that buildings should be located 4 meters from the plot boundary if the wall has windows or doors, or 3 meters if the wall does not have such openings. However, the regulations provide for exceptions for single-family and homestead developments and situations specified in the local development plan.

It is also possible to build a garage directly next to the border, if it is adjacent to an existing building on a neighboring plot and meets the requirements resulting from the local plan or decision on development conditions.

The ministry did not agree to another change

During the consultation, the National Council of the Chamber of Architects of the Republic of Poland proposed removing the term “detached” from the regulations. According to the architects, this would also allow parking garages to be located near the border, constituting an extension of a single-family house.

However, the Ministry of Development and Technology rejected this proposal. This means that the new regulations will not cover garages connected to a residential building. The increased size limits will only apply to detached garages and outbuildings.

The amendment to the regulation is to enter into force September 20, 2026.
