At the end of the third quarter of 2024, 202.2 thousand were waiting for a decision in Polish courts. cases regarding Swiss franc loans – reported the Ministry of Justice. In the third quarter alone, almost 90,000 were received. new cases, which illustrates the scale of the problem faced by the justice system.

Increasing number of complaints about chronicity

Most cases are pending in the Warsaw appellate court, where 71.5 thousand cases are pending. proceedings, of which almost 45 thousand in the District Court in Warsaw. The Ministry emphasizes that the situation in appellate courts is particularly difficult – only 38.6% of cases submitted to second-instance courts are resolved on an ongoing basis.

The number of complaints about the length of proceedings has increased significantly. In 2024, courts accepted more than 20% of such complaints, which is a double increase compared to 2020, when the percentage was 10%. The Ministry of Justice expects that the number of accepted complaints will continue to increase.

In its comments, the Ministry points out the need for further legislative and organizational actions that may improve the situation, but the scale of the problem remains huge.

Actions to relieve the burden on the courts

In order to reduce the number of Swiss franc cases, the Ministry of Justice extended the suspension of income tax collection on settlements concluded between banks and consumers. This action is intended to encourage settlements, which could reduce the burden on the judicial system. Nevertheless, the increase in the number of new cases in the third quarter shows that the problem is still growing.

As many as one third of all Swiss franc cases in Poland are pending in the Warsaw appellate court, which makes it the busiest unit in the country. With such a multitude of proceedings, the waiting time for a judgment may be even longer, and the increase in the number of complaints about excessive length of proceedings indicates that the situation requires urgent action.
