A decision was made regarding the famous case of the construction of the so-called castle in Stobnica. The ruling of the Supreme Administrative Court finally ends the dispute.
Doubts regarding the legality of the construction of the investment in Stobnica have been going on for many years. On Tuesday, the Supreme Administrative Court issued a ruling in the case. The decision was related to the judgment of the Provincial Administrative Court of March 2020, when the earlier resolution of the General Director for Environmental Protection was repealed. However, on Tuesday the Supreme Administrative Court did not accept the cassation appeal of GDOŚ, which means that the consent to build the castle in Stobnica is still in force.

In the justification, Judge Jerzy Stelmasiak pointed out that the improper implementation of the project by the company does not mean that the decision covered by the renewal was defective for this reason – said Judge Jerzy Stelmasiak in the oral justification. As he explained, the authority found a larger area of the redeveloped area when the investment was already being implemented.
The conflict resulted from the decision of the Regional Directorate for Environmental Protection issued in 2015, when it was decided that the construction of the castle in Stobnica did not have to include an environmental assessment. Four years later, RDOŚ changed its mind because the work area was much larger than the reported area of approximately 1.7 ha and ultimately amounted to over 2 ha. However, the Supreme Administrative Court stated that such a circumstance was not taken into account when issuing the first decision.
The castle in Stobnica is legal. The investor does not intend to step back
In an interview with the Polish Press Agency, the investor’s representative, Aneta Fornalik, said that so far no decision has had such an effect that it would lead to the suspension of the construction of the castle in Stobnica, and today’s judgment only confirms this. As the representative of the investment added, construction is still ongoing and the facility is still a multi-family residential building.
A second trial, but a criminal one, is also ongoing in the case of the castle in Stobnica. The proceedings take place before the court in Oborniki.
