A sudden turnaround in the case of a farmer from Gliwice. The services have received new information
A twist in the famous case of a farmer who plowed new asphalt in Gliwice. After the damage assessment was changed, the prosecutor’s office decided to release him.
A 60-year-old farmer who damaged the freshly laid asphalt on the street with a plow. Rybacka in Gliwice-Ostrop, will be released from custody. The prosecutor’s office lifted the most severe preventive measure after receiving a new assessment of losses. Initially, the damage was estimated at approximately PLN 300,000. PLN, which is why the man was accused of destroying property of significant value. However, after additional activities, the prosecutor’s office determined that the losses did not exceed PLN 200,000. zloty. Therefore, the entry regarding property of significant value was removed from the description of the act, and the legal classification of the charge was changed.
As prosecutor Iwona Rosprzak from the District Prosecutor’s Office in Gliwice told PAP, preventive measures of a liberty nature will be applied to the suspect.
A farmer faces a lower penalty for plowing asphalt
Changing the charge means a lower risk of punishment. The basic type of property destruction is punishable by up to five years in prison. In the case of property of significant value, the maximum penalty may be ten years. According to the Penal Code, this threshold exceeds PLN 200,000. zloty.
The District Court in Gliwice had previously decided to arrest the farmer for three months. He justified this by the fact that the suspect faced a severe punishment and the possibility of him taking illegal actions. After changing the classification of the act, the prosecutor’s office decided that further arrest was not necessary.
He plowed about 200 meters of new road
The incident occurred a week earlier. The farmer drove his Ursus tractor onto the fresh surface and used a plow to damage approximately 200 meters of the road. He was arrested red-handed.
The man admitted to plowing the asphalt. However, he claimed that the area belonged to him and the work being carried out was illegal. According to documents available to investigators, the road is owned by the local government.
The Commissioner for Human Rights is examining the decision to arrest
The three-month detention sparked a wide discussion. The field representative of the Ombudsman in Katowice initiated ex officio explanatory proceedings. Its purpose is to determine whether there has been any violation of human rights and freedoms in the case. The representative of the Commissioner for Human Rights asked the Gliwice court to send a justification for the decision to temporarily arrest the 60-year-old.
