A sharp cut to tenants’ rights. Eviction after 60 days for debts!

The rental market in Poland is not in balance. Some apartments are empty because their owners do not want to get stuck in court and fight with dishonest tenants for years. And there is no shortage of them.

In theory, anything can be included in the lease agreement, but enforcing the law in Poland is an ordeal and takes years.

A petition has been submitted to the Senate, which is intended to significantly improve the legal situation of apartment owners. Its author has an idea for quick evictions for debts and even faster court hearings.

Two rents are the limit of safety for apartment tenants

The idea to improve procedures related to rent arrears and evictions of troublesome and indebted tenants is primarily establishing a clear boundary for the protection of tenants’ rightsespecially those who are in arrears with payments – two unpaid rents.

In addition, the right to social housing is only available to people minors and disabled people requiring constant medical care. In other cases, the granting of social housing is to depend on the commune’s capabilities and the tenant’s previous fulfillment of contractual obligations – proposes the author of the petition. If rent arrears exceed six months, social housing is out of the question, except for people who actually need care.

Expedited hearings and even faster evictions

Another suggestion is fish trials. If the rent payment arrears are more than two months, the hearing should be held in an expedited manner.

“The court sets a date for the hearing within 30 days from the delivery of a copy of the lawsuit to the defendant and considers the case within 60 days of filing the lawsuit” – it was written in the petition available on the Senate website.

According to the petition’s author, the owner of the apartment should also have the right to evict him if the commune does not provide social housing within 6 months of the judgment becoming final. In such a case, the owner of the premises could evict the person to temporary accommodation or to a night shelter. Also in winter. “Automatic eviction after 3 months of non-payment of rent will eliminate delays and uncertainty in the courts,” argues the author of the petition.

The Petitions Act, which permanently gives citizens the opportunity to directly influence the legislative process, has been in force in Poland for 10 years. Submitted petitions are considered by the Senate Committee on Human Rights, Rule of Law and Petitions. The committee meets approximately 15 times a year and considers several petitions at one meeting. Over 100 of them are submitted to the Senate every year.
