A revolution in waste segregation is coming. There will be as many as six containers

The amended Waste Act assumes, among other things, changes regarding the segregation of construction waste. It will not be divided into four fractions as before, but into six.

At the beginning of next year, an amendment to the Waste Act prepared by the Ministry of Climate and Environment will come into force. The changes will concern, among other things, the segregation of construction and demolition waste.

Until now, construction waste was divided similarly to regular municipal waste, i.e. into paper, metal, glass and plastic. From next year – as Interia.pl reminds – there will be a division into six fractions:

  • wood,

  • metal,

  • glass,

  • gypsum,

  • plastics,

  • mineral waste, e.g. concrete or brick.

The change regarding the segregation of building materials will apply to, among others, developers, construction companies carrying out renovations and, to some extent, private individuals, because if we hire a company for renovation, we must ensure that it fulfils its obligation to remove and segregate waste.

As noted by “Rzeczpospolita”, the obligation to segregate construction and demolition waste will involve higher costs imposed on entrepreneurs, additional work, and more time. Legal adviser Marcin Nosiński, an expert at the Business Centre Club for construction law and real estate, in a commentary for the newspaper, points out that it will be necessary to find a place on the construction site to place several separate containers, more separate waste transports, and logistics. Investors who decide to have their waste removed by a professional company will have to cover the costs associated with such an agreement.

The draft amendment to the act is to implement Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain directives. The provision requiring entrepreneurs to separate waste at source was to enter into force at the beginning of 2023, but at the end of 2022 the vacatio legis was extended by two years.
