A new obligation for solar owners. The government changes the rules

The government changes the provisions on electro -tripades. Users of older photovoltaic panels will incur new recycling costs.
The Ministry of the Climate is working on an amendment to electro -tracks, which will also include used photovoltaic panels. The bill has already been included in the list of legislative work of the government. The main assumptions are provided for, among others, by New financial obligations for users of some installations and the implementation of the provisions of the EU Directive 2024/884.
New rules
The changes will cover the owners of solar panels introduced to the market between August 13, 2005 and December 31, 2015, unless they were intended for home use. In such cases, recycling costs will no longer rest with the manufacturer, but with the end user. The same rules will apply to electronic equipment not mentioned in the applicable Act, which went to the market between August 13, 2005 and December 31, 2017.
The project also assumes the extension of the definition of the so -called “Old equipment”. The new definition is to cover not only electrical devices placed on the market before August 13, 2005, but also solar panels used in households from before January 1, 2016 and other equipment introduced before January 1, 2018.
Authorized representatives
Changes will affect not only the Act on consumed electrical and electronic equipment, but also provisions regulating packaging waste management, vehicle recycling and the Act on waste.
One of the most important proposals is the introduction of an authorized representative’s institution. He will represent producers who have no headquarters in Poland and will take over their duties related to waste management. The amendment assumes that an authorized representative will be responsible for their full implementation. The adoption of the project by the government is planned in the second or third quarter of 2025.
