A big change for plot owners from September 20. You will be able to build closer to your neighbor
From September 20, the rules for the construction of garages and outbuildings at the border of the plot will change. Permissible objects will be larger than currently.
The basic rule determining the location of a building on a plot depends on whether the wall facing the neighbor has windows or doors. If it has such openings, the building should be at least 4 m from the boundary. For a wall without windows and doors, the minimum distance is 3 m.
However, the regulations provide for exceptions, including: in single-family and farm buildings. In certain cases, a farm building or garage may be located directly next to the border or at least 1.5 m from it. Currently, this possibility applies to objects with a length not exceeding 6.5 m and a height of up to 3 m.
Garage at the border of the plot. The limits are to increase
The Ministry of Development and Technology is working on amending the regulation regarding the technical conditions of buildings and their location. One of the approved changes assumes an increase in the permissible dimensions of detached garages and farm buildings located directly next to the border or not less than 1.5 m from it.
After the changes, the maximum length of such an object is to increase from 6.5 to 7 meters. An even bigger difference will be in height. The current limit of 3 m is to be increased to 3.5 m.
There are also other exceptions to the 3-meter rule
Special solutions concern, among others: building plots 16 m wide or less. The garage or outbuilding may then be located with a wall without windows or doors directly at the border or at a distance of 1.5 to 3 m.
It is also possible to build a building directly next to the border if it is adjacent to a building existing on the neighboring property. However, its height must meet the requirements resulting from the local plan or decision on development conditions. The local plan itself may also allow for construction closer to the border.
Not every garage will be subject to more lenient rules
The National Council of the Chamber of Architects of the Republic of Poland proposed an additional change. She wanted the term “detached” to be removed from the regulations. In practice, this would allow the new solution to be used more widely, also for garages adjacent to single-family houses.
However, the ministry did not accept this demand. On this basis, the Ministry does not intend to allow the construction of a garage constituting an extension of a single-family house directly next to the border. However, he agreed to increase the length and height of detached garages and outbuildings. The regulation is to enter into force September 20, 2026
